These Terms (“Terms”) govern your use of hanaschustersmith.com and any purchases from Hana Schuster Smith Studio (“we”, “us”, “our”). By using the site or placing an order, you agree to these Terms.

Eligibility & site use
You must be at least 18, or use the site with a parent/guardian. You agree not to misuse the site (no scraping, hacking, or infringing activity).
Products, colors & sizing
We try to describe and photograph artworks accurately; colors can vary by screen. Dimensions are approximate. Frames/ mounting are shown when noted.
Orders & payment
All prices are in USD and may change without notice.
Taxes are collected where required. You authorize our payment processor (e.g., Stripe/PayPal) to charge your card.
We may refuse or cancel an order (e.g., inventory or pricing error). If we do, you’ll receive a prompt refund.
Shipping & delivery
Shipping area: Contiguous U.S. only (the lower 48 states). I do not ship to Alaska, Hawaii, U.S. territories (including Puerto Rico), Canada, or international addresses at this point.
Carrier: USPS for most work; larger pieces may ship UPS/FedEx.
Tracking: You’ll receive a tracking link when your order goes out.
Packaging: Archival wraps, corner protection, and rigid boxes as needed.
Local pickup: Available by appointment at my studio.
Returns, cancellations & damages
Original art sales are final. If you have an issue, please contact us.
If a piece arrives damaged, email photos within 7 days of delivery so we can file a claim and make it right.
Orders may be cancelled before shipment - email us as soon as possible.
Commissions & custom work (if offered)
Commissions begin with a proposal and a non-refundable deposit of $500 to secure time and materials.
Timelines are estimates; final sale at delivery. Small adjustments are included; major scope changes may affect price and schedule.
Intellectual property
All artwork, images, and content are protected by copyright owned by Hana Schuster Smith Studio (or the respective rights holder). Purchasing an artwork does not transfer copyright or reproduction rights. You may display the physical work for personal, non-commercial use. No copying, printing, training AI models, or commercial use without written permission.
Third-party services
We use providers like Squarespace (site hosting), Stripe/Paypal (payments), and USPS/UPS/FedEx (shipping). Their services are subject to their own terms.
Promotions & gift cards (if offered)
Promo codes must be used within the stated time and can’t be combined unless we say so. Gift cards are not reloadable or redeemable for cash except as required by law.
Disclaimers
Te site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for particular purpose.
Limitations of liability
To the fullest extent permitted by law, our total liability for any claim relating to your use of the site or purchase of products is limited to the amount you paid for the item at issue. We are not liable for indirect, incidental, special, or consequential damages.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the site or violation of these Terms.
Governing law & venue
These Terms are governed by the laws of the State of Colorado, without regard to conflicts principles. You agree to exclusive jurisdiction and venue in the state or federal courts located in Boulder, Colorado.
Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted here with the updated date. Your continued use of the site means you accept the changes.
